The application and/or app and/or system and/or website operating under the trade name "Pinker" or "פינקר" (hereinafter the "Application") is operated and owned by Pinker Technologies Ltd. (the "Company").
The Application enables users to give and receive positive messages from other users, with statistics and segmented feedback to create a more positive and humane social space (hereinafter: the "System"), subject to these Terms of Use (the "Terms"), and to the Privacy Policy set forth below.
Where the System permits a business user to purchase and/or consume paid services and/or products through the System, special rules may apply which, by default, do not permit cancellation of the transaction, return of the product to the manufacturer, monetary refunds, other credits, or other statutory consumer protections.
Therefore, you should read these Terms carefully before using the Application. Your use of the Application constitutes your acceptance of all provisions of these Terms, which shall form the legal basis for any dispute between you and the Company.
If you do not agree to any of the provisions of these Terms, you must refrain from using the Application or any part thereof.
These Terms apply to the entire Application and the System included therein, and to your use of any content contained within, including any products and/or services offered through the Application (collectively and severally, the "Products" and/or "Services"), and to transactions involving them.
For the purposes of these Terms, "Content" means any service, product, source code, software module, software application, drawing, rendering, text, photograph, image, design, illustration, map, audio clip, video clip, graphics, expression, creation, knowledge or other information, in two or three dimensions, in whole or in part, by any means of communication or connection, whether paid or free, uploaded by you and/or a third party, and includes all intellectual property rights related to such items, including but not limited to patents, trademarks, copyrights and moral rights.
These Terms apply to all user types (hereinafter: "User"), including any person who designs, specifies, purchases, orders, sells, manufactures, and/or supplies Products or Services, as well as anyone who browses, views, accesses, or otherwise uses or interacts with the Application (hereinafter: "Use").
Where the masculine form is used in these Terms, it is for convenience only and refers equally to men and women; references to the singular include the plural and vice versa.
Your use of the Application and the information contained therein is subject to applicable law and these Terms. The Company reserves the right to amend these Terms, and you hereby agree in advance that any subsequent use of the Application after such amendments shall be deemed acceptance of the updated version.
If you are under the age of 18, you are not permitted to use the Application without parental consent. By using the Application you confirm that your parents have read and consent to these Terms.
Obtaining any licenses required to use the Application for business purposes such as business licenses, driving licenses, or other permits-together with insurance, tax payments, and any other legal arrangements necessary to undertake professional or business activities through the Application, are your sole responsibility. Your use of information, Products and/or Services via the Application is at your exclusive responsibility and subject to these Terms.
The Application is provided "as is". Use of the Application and its Content and Services is at your sole and exclusive risk. The Company does not warrant that the Content will be updated at all times. Nothing contained in the Application should be construed as a recommendation by the Company.
To access the Application or any part thereof you may be required to provide a username and password and/or connect via third parties (such as Facebook, Google, or others). The storage and use of such information shall be governed by the Application's Privacy Policy and by applicable law.
The Company may require you to enter access credentials at any time, may begin or cease requiring them, and may do so periodically, all at its sole and absolute discretion, without prior notice. The Company reserves the right to permit or deny access to the Application at any time, and to modify or discontinue access, all at its sole discretion.
Access to certain features, services, or actions in the Application may be available to some users and limited or unavailable to others, or subject to conditions, all at the Company's sole and absolute discretion.
The Company reserves the right to decide which Content will appear and/or be published, or to remove/add Content, at its sole and absolute discretion, without prior notice. The Company may change, add, remove, or update the Application's Content, appearance, operation, or available Products and Services at any time, without prior notice and at its sole discretion.
The Company reserves the right to include advertising, offers to purchase services and/or Products (its own or others'), or other commercial content in the Application (hereinafter, "Advertisements"). Advertisements appearing in or sent via the Application are the sole responsibility of the advertisers.
If an Advertisement appearing in the Application contains offensive, immoral, or illegal content, or causes any damage, you may contact the Company and request removal of such offensive content that was submitted by others, insofar as the Company has control over it; the Company and its representatives shall not be liable for such content.
Use of the Application is permitted only for positive, honest, and good-faith purposes.
The Company reserves the right to implement access methods, search mechanisms, and/or search engines that enable access to certain Content in the Application or parts thereof, in accordance with the Company's choices, and to change or discontinue such mechanisms at its sole discretion.
You acknowledge that technical faults may occur for any reason and may prevent or disrupt access to or use of the Application, including due to communication problems or maintenance. Use of the Application may be interrupted or terminated without completion or saving of a transaction or data. The Company shall not be liable for such occurrences; to the extent possible you should retain copies of any information you intend to use or upload to the Application before doing so, including any documents or data related directly or indirectly to actions you perform via the Application.
You must not use the Application or its Content in an offensive, cynical, disparaging or otherwise negative manner contrary to the Company's objectives, nor engage in any conduct that breaches these Terms, laws, accepted practice, or public order.
Without derogating from the foregoing, you must not exploit any of the Company's or third parties' intellectual property rights without prior written consent, including (without limitation) copying, saving as a file, duplication, distribution, processing, deletion, addition, alteration, sale, rental, lending, delivery, public display, public performance, derivative creation, or any other use.
Anyone who engages in such unauthorized use risks criminal prosecution and civil proceedings, including injunctions, searches and seizures, claims for monetary damages, detention of goods, arrest, imprisonment, and any other enforcement measures the Company deems appropriate.
If, in the course of using the Application (search, product specification, product design, ordering, purchasing, or other activity), the Application enables you to input information and/or Content, responsibility for such Content and for its meaning and insertion shall rest solely with you.
Without derogating from the foregoing, you must not input Content that is untrue, erroneous, misleading, or that may harm any person, reputation, privacy, property or rights, and you must not use the Application or its Content contrary to these Terms or applicable law.
The Company reserves the right to edit, modify, or delete Content of an offensive, cynical, negative, immoral, or illegal nature, or to do so following a third-party complaint. You hereby give your explicit consent to such modification and/or deletion immediately and without further agreement or prior notice.
The Company may enable users to purchase Products and/or Services and to specify and design Products for that purpose through the System, and may allow users (including the Company) to receive orders/offers (hereinafter: "Orders" or "Offers"), and to sell and supply Products and/or Services pursuant to such Orders.
Each Product and/or Service offered in the Application shall display the product's details, price, delivery terms, and other conditions which constitute an integral part of each transaction. Prices shown in the Application, if any, are valid as of the date displayed and may be updated from time to time at the Company's or relevant supplier's discretion, and may differ from prices offered for the same transaction outside the Application.
Content in the Application may contain errors, including with regard to delivery dates, prices, payment terms, etc., and the Company reserves the right to correct any such error at any time as long as the product has not yet been delivered to the purchaser. It is clarified that an error in a Product's price in the Application will be corrected according to the price of identical (or, where possible, similar) products sold in the ordinary course of business in the Application.
You expressly agree that the Company is completely exempt from liability for any loss, damage or inconvenience to you or others regarding transactions between users made using the Application. If an order was not completed due to an Application malfunction, the user shall first contact the Company for technical support; if the malfunction is not resolved, the user shall be entitled to a credit for any amount already paid.
Payment for transactions in the Application shall be by credit card unless otherwise agreed in writing by the Company. When making a transaction by credit card you represent that the card used belongs to you or to the entity on whose behalf you are acting, that the card is valid and that you are authorized under law or under your agreement with the card issuer to perform a transaction in the amount in question.
You further represent that the registration details you provide are correct, complete, accurate and up to date. A transaction performed on behalf of a corporation also constitutes a representation that the person performing the transaction is authorized under that corporation's governing documents to contract with the Company.
Submission of incorrect, false, or misleading user data or payment details (including card expiry, card number, address, ID number, or any detail that prevents the Company from completing a transaction), whether intentionally or unintentionally, shall render the transaction void and the Company shall have no liability to the user under any circumstances.
If payment is not made on time for any transaction, the Company may act immediately and without notice to charge all authorized transactions, close the purchaser's account, and prevent access to the Application.
The Company's intellectual property rights in the Application are protected in Israel and abroad under Israeli law and international treaties. The Company respects the ownership and intellectual property rights of others, and you must do the same.
The Application and its Content are the exclusive property of the Company and may not be used except for ordering Products and/or Services in accordance with these Terms.
Unless explicitly agreed otherwise in writing in advance, information and/or intellectual property rights in the Application are owned solely by the Company, including copyrights, moral rights, trademarks, service marks, trade names, designs, patents, works, inventions, trade secrets, technical information, functional information, professional information, commercial and business information, and any other intellectual property rights, whether registered or not.
You must not publish, copy, distribute, exploit or otherwise use information appearing in the Application unless the Company has granted its express written consent in advance.
The interpretation and enforcement of these Terms shall be governed exclusively by the laws of the State of Israel. Any transaction conducted through the Application shall be subject solely to Israeli law, and any legal proceeding arising from actions taken via the Application shall be brought in the competent courts in the Tel Aviv District.
The purpose of this Privacy Policy is to explain the Company's practices with respect to user privacy in the System, and to describe how the Company uses information provided by users or collected during use of the System.
When you use the System's services, the Company receives information about you. Some information is personally identifying, such as your name, address, email address, Products and Services you purchased or expressed interest in, transaction history, payment confirmations—this is information you knowingly supply when registering for services or while using the System in order to complete a transaction.
Some information identifies your behavior on the site for purposes such as remarketing, legal monitoring, and statistical analysis, and may include call recordings, advertisements you viewed in the System, pages you viewed, pages that referred you to the Company, Services that interested you, and the IP address from which you accessed the System.
Collected information shall be used only in accordance with this Privacy Policy and applicable law for purposes including, but not limited to:
The Company may use technologies that store small pieces of information about your use of the System, commonly known as cookies, for the purposes set forth above and subject to this Privacy Policy and applicable law.
The Company allows other companies to manage ad services in the System according to their policies. Advertisements shown during your visit are served from the servers of those third parties. To manage their advertisements, these companies place cookies on your device. Such cookies allow them to collect information about which ads they showed you, which ads you viewed, and which you interacted with. The use of cookies by these companies is governed by their own privacy policies, not by the Company's.
The Company may from time to time send you information regarding transactions relevant to you, as well as marketing and promotional materials by email, WhatsApp or other relevant applications. You may unsubscribe from marketing and promotional communications at any time.
The Company will not disclose your personal information to advertisers or third parties not specified above. However, the Company may transmit aggregate statistical information regarding user activity on the System. Statistical information transferred will not identify you personally.
The Company may transfer user information to third parties who act as suppliers enabling provision of Services in the System and/or for advertising purposes via cookies, and/or for the purposes stated above. The Company will not transfer your personal details and activity information to other third parties except in the following circumstances:
The Company implements up-to-date information security procedures. While such procedures reduce the risk of unauthorized access, they do not guarantee absolute security. Therefore, the Company does not warrant that its services are entirely immune from unauthorized access; protection is relative and in accordance with applicable law.
Under the Privacy Protection Law, 1981 (the Privacy Protection Law), every individual is entitled to access information held about them in a database. A person who reviews the information held about them and finds it to be inaccurate, incomplete, unclear or not up to date may request correction or deletion of that information from the database owner.
Such requests should be directed to us via the contact details on the Contact page, and you should verify receipt of the request. Additionally, if information in the Company's databases is used to contact you personally, you are entitled under the Privacy Protection Law to request in writing that the information pertaining to you be removed from those databases.
In any case where material changes are made to this Policy that affect the use of personal information you have provided, a notice of such changes will be published within the System.
היישום ו/או האפליקציה ו/או המערכת ו/או האתר בעלי השם המסחרי "פינקר" או "Pinker" (להלן: "היישום") מופעל ע"י חברת פינקר טכנולוגיות בע"מ ("החברה") ובבעלותה.
היישום מאפשר למשתמשים להעניק ולקבל מסרים חיוביים ממשתמשים אחרים, עם סטטיסטיקות ופילוחים של המשובים לשם יצירת מרחב חברתי ואנושי חיובי וטוב יותר (להלן: "המערכת"), וזאת בכפוף להוראות תנאי שימוש אלו ("להלן: "התקנון"), ולתנאי מדיניות הפרטיות להלן.
במקרים בהם המערכת תאפשר למשתמש עסקי לרכוש ו/או לצרוך שירותים ו/או מוצרים בתשלום דרך המערכת, יתכן ויחולו עליהם כללים מיוחדים שכברירת מחדל לא מאפשרים ביטול עסקה, החזרה של מוצר ליצרן, החזר כספי, זיכויים אחרים, או הוראות אחרות עפ"י חוק הגנת הצרכן. על כן יש לקרוא הוראות תנאי שימוש אלו בעיון, טרם שימושך ביישום.
שימוש ביישום זה מהווה הסכמתך להוראות תנאי שימוש אלו כולן, ואלו יהוו את הבסיס המשפטי לכל דיון בינך לבין החברה. בהעדר הסכמה לאילו מהתנאים הכלולים בתנאי שימוש אלו, עליך להימנע מכל שימוש ביישום או חלקו.
תנאי שימוש אלו חלים על מלוא היישום והמערכת הכלולה בו, ועל השימוש בהם ובתכנים הכלולים בהם, לרבות מוצרים ו/או שירותים כלשהם ביישום (להלן, ביחד ולחוד: "מוצרים" ו/או "שירותים") ועל עסקאות בהם.
בתנאי שימוש אלו, הביטוי "תוכן" כולל כל שירות, מוצר, קוד מקור, מודול תוכנה, יישום תוכנה, שרטוט, הדמיה, טקסט, תצלום, תמונה, עיצוב, איור, מפה, קטע צליל, קטע וידיאו, גרפיקה, ביטוי, יצירה, ידע או מידע אחר, בדו-מימד ו/או בתלת מימד, בשלמותם ו/או בחלקם, וזאת בכל אמצעי תקשורת ו/או קשר, בין בתשלום ובין בלא תשלום, על ידך ו/או צד שלישי כלשהו, וכן כל זכות קניין רוחני, לרבות, אך לא רק, פטנטים, סימני מסחר זכויות יוצרים וזכויות מוסרית, וזכויות קניין רוחני אחרות הכלולות, נלוות ו/או מתייחסות לאלו מהם.
תקנון היישום חל על כל סוג משתמש (להלן: "משתמש") לרבות כל מי שמתכנן, מאפיין, רוכש, מזמין, מוכר, מייצר, ו/או מספק מוצרים ושירותים וכן על כל מי שמעיין בתכני היישום, משוטט בו, ניגש אליו בדרך כלשהי ו/או עושה בו שימוש אחר כלשהו (להלן: "שימוש").
בתנאי שימוש אלו, פנייה בלשון זכר או נקבה הינה לצרכי נוחות בלבד, והפנייה בכל לשון משמעה פניה לנשים ולגברים כאחד, ופניה ליחיד משמעה גם פניה לרבים ולהפך.
השימוש שלך ביישום ובמידע הכלול בו הינו בכפוף לכל דין ולתנאי שימוש אלו. החברה שומרת לעצמה את הזכות לשנות הוראות תנאי שימוש אלו, והנך להסכים בזאת מראש כי בכל שימוש שלך ביישום לאחר המועד שבו תנאים אלו השתנו הנך לקבל על עצמך את הגרסה המעודכנת.
אם הנך מתחת לגיל 18, אינך מורשה להשתמש ביישום ללא הסכמת הוריך. על ידי שימוש שלך ביישום, אתה מאשר שהם קראו ומסכימים להוראות תקנון אלה.
הסדרת רישיונות כלשהם לצורך שימוש ביישום כגון מכירה, ייצור, אספקה, משלוח וכד', (ובכלל זה, אך לא רק, רישיון עסק, רשיון נהיגה או רשיון אחר), כמו גם ביטוח מכל סוג, תשלומי מיסים ו/או הוצאות ו/או הסדרה של עניינים אחרים הנובעים מהוראות כל דין לצורך ביצוע פעילות מקצועית, עסקית או אחרת באמצעות יישום זה ובכלל, הנם באחריותך בלבד כמשתמש.
השימוש במידע, במוצרים ו/או בשירותים כלשהם באמצעות היישום ובכלל הינם באחריותך הבלעדית ובכפוף להוראות תקנון אלו. היישום ניתן לשימוש כמות שהוא (as is), והשימוש בו ובתכנים ובשירותים הכלולים בו ייעשו על אחריותך הבלעדית והמלאה. החברה אינה מתחייבת כי התכנים ביישום יהיו מעודכנים בכל עת. אין לפרש דבר מן האמור ביישום כהמלצה כלשהי מטעם החברה.
לצורך גישה ליישום ו/או חלקו יתכן ויהיה עליך להזין שם משתמש וסיסמה ו/או לאפשר חיבור ליישום באמצעות צדדים שלישיים כגון פייסבוק, גוגל ואחרים. השמירה והשימוש במידע זה הינם בהתאם למדיניות הפרטיות של היישום ובכפוף לכל דין.
החברה רשאית לדרוש ממך בכל עת להזין פרטי גישה ליישום ללא הודעה מוקדמת, או להוסיף לדרוש זאת, או להפסיק לדרוש זאת, או לעשות כן מדי פעם בפעם, ללא הודעה מוקדמת, ולפי שיקול דעתה המוחלט והבלעדי.
החברה שומרת לעצמה את הזכות לאפשר שימוש או למנוע שימוש ביישום בכל עת, וכן לשנות ו/או להפסיק לעשות כן, והכל לפי שיקול דעתה הבלעדי.
יכול שהגישה למערכת ו/או לשירותים ביישום או חלקם, והאפשרות לבצע פעולות מסוימות, תתאפשר למשתמשים מסוימים אך תהא מוגבלת למשתמשים אחרים, או לא תתאפשר כלל ו/או תהא מותנית בתנאים, הכל לפי שיקול דעתה המוחלט והבלעדי של החברה.
החברה שומרת לעצמה את הזכות לבחור אלו תכנים יופיעו ו/או יפורסמו, או יפסיקו/יוסיפו להופיע ו/או להתפרסם ביישום, או יופיעו/יתפרסמו מדי פעם בפעם, הכל לפי שיקול דעתה הבלעדי והמוחלט, וללא הודעה מראש או עדכון בדיעבד.
החברה עשויה לשנות, להוסיף, לגרוע, למחוק ולעדכן מעת לעת את תכני היישום ו/או מראה היישום ו/או אופן פעולתו ו/או אופן השימוש בו ו/או מוצרים ו/או שירותים הכלולים בו, ללא הודעה מוקדמת ולפי שיקול דעתה הבלעדי.
החברה שומרת לעצמה את הזכות לכלול ביישום תכנים המהווים פרסומות, הצעות לרכישת שירותים ו/או מוצרים, שלה ו/או של אחרים ו/או תכנים מסחריים אחרים כלשהם (להלן: "פרסומות").
הפרסומות שיופיעו ביישום ו/או שיישלחו למשתמשים בו, הינן באחריות המלאה והבלעדית של המפרסמים. אם יופיע בפרסומת כלשהי ביישום תוכן פוגעני, בלתי מוסרי, בלתי חוקי, או אם ייגרם באמצעותם ו/או בגינם נזק מכל סוג, זו זכותך לפנות לחברה ולבקש מחיקה של תכנים פוגעניים שהוזנו ליישום ע"י אחרים, ככל שלחברה שליטה על כך, ולחברה ו/או מי מטעמם אין ולא תהא כל אחריות על תכנים אלו.
השימוש באפליקציה מותרת אך ורק מתוך כוונה חיובית וכנה, ובתום לב.
החברה שומרת לעצמה את הזכות להפעיל דרכי גישה, אמצעי חיפוש ו/או מנועי חיפוש ביישום, שיאפשרו גישה לתכנים מסוימים ביישום ו/או בחלק ממנו, עפ"י בחירת החברה, וכן לשנות ו/או להפסיק לעשות כן, והכל לפי שיקול דעתה הבלעדי.
הנך מודע כי יתכנו תקלות מכל סיבה שהיא העלולות למנוע את הגישה ו/או השימוש ביישום, או להכביד עליהם, לרבות עקב קשיי תקשורת ו/או עקב תחזוקת היישום ו/או מטעמים אחרים, ויכול שהשימוש ביישום ייקטע ו/או יופסק ללא השלמה ו/או שמירה של עסקה ו/או נתונים. החברה תהיה פטורה מכל אחריות לכך, וככל האפשר עליך לשמור כל מידע שבדעתך לעשות בו שימוש או להזין ליישום, בטרם עשותך כן.
אין לעשות ביישום ו/או בתכניו כל שימוש פוגעני ו/או ציני ו/או מזלזל ו/או מנוגד למטרות החברה ו/או כל ענין שלילי אחר באדם כלשהו ו/או שמו הטוב ו/או רכושו ו/או פרטיותו ו/או זכויותיו, ואין לעשות שימוש כלשהו ביישום ו/או בתכניו שהינו בניגוד לתנאי שימוש אלו ו/או הוראות כל דין, נוהג, ו/או תקנת הציבור.
בכלל זה, ומבלי לגרוע מכלליות האמור לעיל, אין לנצל איזו מזכויות הקניין הרוחני של החברה ו/או צד שלישי כלשהו ללא הסכמתם מראש ובכתב, לרבות, אך לא רק, בדרך של גזירה, העתקה, שמירה כקובץ, שכפול, הפצה, עיבוד, מחיקה, תוספת, שינוי, מכירה, השכרה, השאלה, מסירה, הצגה פומבית, ביצוע פומבי, יצירה נגזרת, או כל דרך אחרת.
העושה כן ללא היתר מפורש מאת החברה, מראש ובכתב, ככל שיינתן ובכפוף לתנאיו, מסתכן בהעמדה לדין פלילי ובהליכים אזרחיים, לרבות צווי מניעה, חיפוש, תפיסה, תביעות כספיות, עיכוב טובין, מעצר, מאסר, וכל אמצעי אכיפה אחר ו/או נוסף שהחברה ימצאו לנכון.
אם במסגרת שימוש ביישום, חיפוש, אפיון מוצרים, תכנונם, הזמנת מוצרים ו/או שירותים, קניה, מכירה ו/או פעילות אחרת באמצעות היישום, היישום יאפשר לך להזין מידע ו/או תכנים כלשהם, האחריות על תכנים אלו, משמעותם ועצם הזנתם תחול עליך בלבד.
מבלי לגרוע מהאמור לעיל, אין להזין ליישום תוכן כלשהו שאינו אמת, מוטעה, מטעה, או שעלול לפגוע באדם כלשהו, שמו הטוב, פרטיותו, קנייניו או זכויותיו, ואין לעשות שימוש כלשהו ביישום ו/או בתכניו בניגוד להוראות תנאי שימוש אלו ו/או הוראות כל דין.
החברה שומרת לעצמה את הזכות, לערוך, לשנות ואף למחוק תכנים כגון בעלי אופי פוגעני, ציני, שלילי, בלתי מוסרי, בלתי חוקי, או עקב תלונה על כך ע"י צד שלישי כלשהו. הנך נותן בזאת את הסכמתך המפורשת לעריכת שינויי תוכן ו/או עריכה ו/או מחיקה של תכנים אלו, באופן מיידי וללא כל הסכמה נוספת או התראה מראש.
החברה יכולה שתאפשר למשתמשים לרכוש מוצרים ו/או שירותים וכן לאפיין ולתכנן מוצרים לשם כך באמצעות המערכת, וכן מאפשרת למשתמשים (לרבות החברה) לקבל הזמנות/הצעות (להלן "הצעות" או הזמנות"), וכן למכור ולספק מוצרים ו/או שירותים עפ"י ההזמנה.
בצד כל מוצר ו/או שירות המוצע ביישום מופיעים פרטיו של המוצר ו/או השירות המוצע למכירה, מחירו, תנאי אספקתו ויתר תנאי המוצר ו/או השירות המהווים חלק בלתי נפרד מכל עסקה.
מחירים ביישום, ככל שיהיו כאלה, נכונים למועד הצגתם, ועשויים להתעדכן ולהשתנות מעת לעת לפי שיקול דעת החברה או הספק הרלבנטי, והם עשויים להיות שונים ממחירים שמוצעים לאותה עסקה, שלא דרך היישום (זולים יותר או יקרים יותר).
בתכני היישום עלולות ליפול שגיאות לרבות במועדי אספקה, מחירים, תנאי תשלום ועוד, והחברה שומרת על זכותה לתקן כל טעות כאמור בכל עת כל עוד לא סופק המוצר למזמין. יובהר כי טעות במחיר מוצר ביישום, תתוקן בהתאם למחיר מוצרים זהים (או קרובים אליהם ככל האפשר), הנמכרים במהלך העסקים הרגיל ביישום.
הנך להסכים בזאת במפורש כי החברה פטורה לחלוטין מכל אחריות, נזק או אי נוחות, לך או לאחרים, לגבי עסקאות בין משתמשים, תוך שימוש ביישום. ככל שעסקה לא בוצעה עקב תקלה ביישום, המשתמש יפנה לחברה לקבלת תמיכה טכנית תחילה, וככל שהתקלה לא תיפתר, המשתמש יהיה זכאי לזיכוי על סכום שכבר שילם.
התשלום עבור עסקאות ביישום הוא באמצעות כרטיס אשראי, אלא אם יוסכם אחרת באישור החברה. בביצוע עסקה בכרטיס אשראי הנך מצהיר כי הכרטיס באמצעותו מבוצעת העסקה שייך לך, או לתאגיד בשמו הינך מבצע את העסקה, כי הכרטיס הינו בתוקף וכי הנך מורשה על פי כל דין ו/או הסכם עם מנפיק כרטיס האשראי לבצע עסקה בסכום העסקה הרלוונטי באמצעות הכרטיס.
מסירת פרטי משתמש או פרטי משתמש לא נכונים, שגויים או כוזבים ו/או פרטים כוזבים אודות כרטיס האשראי תגרום לביטול תוקף העסקה והחברה לא תהיה מחויבת כלפי המשתמש בשום תנאי ובשום אופן. הגשת מידע כוזב הינו עבירה פלילית והעושה כן, צפוי להליכים משפטיים פליליים ואזרחיים.
באי ביצוע תשלום במועד לעסקה כלשהי, החברה תהיה רשאית לפעול מיידית וללא הודעה או התראה מכל סוג למזמין, כולל סליקה מידית של עסקאות, סגירת חשבון המזמין ומניעת גישה ליישום.
זכויות הקניין הרוחני ביישום מוגנות בישראל ובחו"ל מכוח חוקי מדינת ישראל ואמנות בינלאומיות. החברה מכבדת זכויות בעלות וזכויות קניין רוחני של אחרים, וגם עליך לעשות כן. היישום ותכניו הם הרכוש הבלעדי של החברה, ואין היא מרשה לעשות בהם שימוש כלשהו למעט הזמנת שירותים ו/או מוצרים בכפוף לתנאי שימוש אלו.
אלא אם הוסכם במפורש אחרת מראש ובכתב, המידע ו/או זכויות הקניין הרוחני ביישום הם של החברה בלבד. אין לפרסם, להעתיק, להפיץ, לנצל או להשתמש בכל דרך אחרת במידע המופיע ביישום אלא אם כן נתנה החברה את הסכמתה לכך בכתב ומראש.
החברה שומרת לעצמה את הזכות לאכוף, להסיר, לשנות, לתקן, ולמנוע כל שימוש ו/או הזנה ליישום ו/או פרסום של תכנים המפרים זכויות קניין רוחני, שלה ו/או של צדדים שלישיים.
התנאים המובאים לעיל ולהלן, פרשנותם ואכיפתם נשלטים על-ידי חוקי מדינת ישראל בלבד. כל העסקאות המתבצעות באמצעות יישום זה כפופות לדין הישראלי בלבד וכל הליך משפטי בגין כל עילה שמקורה בפעולה משפטית שהתבצעה ביישום זה יתברר בבית המשפט המוסמך במחוז ת"א בלבד.
מטרת מדיניות פרטיות זו היא להסביר מה הם נוהגי החברה ביחס לפרטיות המשתמשים במערכת, וכיצד משתמשת החברה במידע הנמסר לה על-ידי המשתמשים במערכת או הנאסף על-ידה בעת השימוש במערכת.
בעת שימושך בשירותי המערכת יתקבל אצל החברה מידע עליך, חלק מהמידע מזהה אותך באופן אישי, כגון בשמך, בכתובתך, כתובת אימייל, מוצרים ושירותים שרכשת או התעניינת בהם, היסטוריית העסקה, אישורי העסקה, אמצעי תשלום שלך. זהו המידע שאתה מוסר ביודעין, בעת שתירשם לשירותים במערכת או תוך כדי השימוש בה לקיום עסקה.
חלק מהמידע מזהה את התנהגותך באתר לצורך הצעת שירות חוזר (Re-marketing), מעקב משפטי וניתוחים סטטיסטיים, וכולל הקלטות שיחות עמך, פרסומות שקראת במערכת, העמודים שבהם צפית, העמודים באתר שמהם פנית לחברה, השירותים שעניינו אותך, כתובת האינטרנט (IP) שממנה פנית.
השימוש במידע שנאסף ייעשה רק על פי מדיניות פרטיות זו ובכפוף להוראות כל דין:
החברה יכולה לעשות שימוש בטכנולוגיה לשמירת פיסות מידע על שימושך במערכת, המכונה Cookie ("קוקית"), וזאת למטרות הפורטות לעיל ובכפוף להוראות מדיניות פרטיות אלו והוראות כל דין.
החברה מתירה לחברות אחרות לנהל את מערך הפרסומות במערכת עפ"י מדיניותה. השימוש שחברות אלה עושות בקוקיתות כפוף למדיניות הפרטיות שלהן ולא למדיניות הפרטיות של החברה.
החברה יכולה שתהיה מעוניינת לשלוח אליך מדי פעם בדואר אלקטרוני ו/או בווטסאפ ו/או בכל יישום רלוונטי אחר מידע בדבר העסקאות הרלוונטיות אליך, וכן מידע שיווקי ופרסומי. בכל עת תוכל לבטל את הסכמתך מלקבל מידע שיווקי ופרסומי שישוגר אליך, ולחדול מקבלתו.
החברה לא תמסור את המידע עליך או חלקו למפרסמים או לצדדים שלישיים שלא צוינו במפורש לעיל. עם זאת, היא רשאית להעביר מידע סטטיסטי על פעילות המשתמשים במערכת. מידע סטטיסטי שיועבר לא יזהה אותך אישית.
החברה לא תעביר לצדדים שלישיים אחרים את פרטיך האישיים והמידע שנאסף על פעילותך במערכת אלא במקרים המפורטים להלן:
החברה מיישמת במערכת נהלי אבטחת מידע עדכניים. בעוד שנהלים אלה מצמצמים את הסיכונים לחדירה בלתי-מורשית, אין הם מעניקים בטחון מוחלט. לכן, החברה לא מתחייבת ששירותיה יהיו חסינים באופן מוחלט מפני גישה בלתי-מורשית למידע המאוחסן בהם, אלא מוגנים באופן יחסי בהתאם להוראות כל דין.
על-פי חוק הגנת הפרטיות, התשמ"א - 1981, כל אדם זכאי לעיין במידע שעליו המוחזק במאגר מידע. אדם שעיין במידע שעליו ומצא כי אינו נכון, שלם, ברור או מעודכן, רשאי לפנות לבעל מאגר המידע בבקשה לתקן את המידע או למוחקו.
פנייה כזאת יש להפנות אלינו לפי הפרטים בדף צור קשר, ולוודא את קבלת המידע.
בכל מקרה בו יבוצעו במדיניות זו שינויים מהותיים בהוראות שעניינן השימוש במידע אישי שמסרת, תפורסם על-כך הודעה במערכת.
